No obstant aix\u00f2, el Tribunal de Just\u00edcia de la Uni\u00f3 Europea ha assenyalat en la seva \u00a0<a href=\"https:\/\/asufin.com\/wp-content\/uploads\/2020\/07\/STJUE_200716_CAIXABANK_C-224-19_BBVA_C-269-19_GASTOS.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Sent\u00e8ncia en els assumptes acumulats C-224\/19 i C-259\/19<\/a>\u00a0 que \u201cs&#8217;oposa al fet que, en cas de nul\u00b7litat d&#8217;una cl\u00e0usula contractual abusiva que imposa al consumidor el pagament de la totalitat de les despeses de constituci\u00f3 i cancel\u00b7laci\u00f3 d&#8217;hipoteca, <strong>el jutge nacional negui al consumidor la devoluci\u00f3 de les quantitats abonades en virtut d&#8217;aquesta cl\u00e0usula\u201d.<\/strong><\/p><p>Aix\u00ed mateix, la sent\u00e8ncia dictamina que una cl\u00e0usula contractual que sigui declarada nul\u00b7la, tal com va fer el Tribunal Suprem en la seva <a href=\"https:\/\/asufin.com\/sentencias\/supremo\/2015-12\/STS_151223_BPOPULAR_BBVA_OCU_SUELO_RESOLUCION_ANTICIPADA_INTERESES.pdf\" target=\"_blank\" rel=\"noopener\">Sent\u00e8ncia 705\/2015, de 23 de desembre<\/a>,, <strong>no podr\u00e0 tenir efectes enfront del consumidor en tant que s&#8217;ha de deixar sense aplicaci\u00f3.<\/strong><\/p><p>Es calcula que m\u00e9s de <strong>8 milions de consumidors<\/strong> haurien pogut pagar aquestes despeses indegudament i que ara podrien recuperar gr\u00e0cies a aquesta sent\u00e8ncia.<\/p><p><a href=\"https:\/\/asufin.com\/asufin-gana-una-colectiva-de-gastos-hipotecarios-que-permitira-recuperar-1-500-euros-de-media-sin-necesidad-de-litigar\/\" target=\"_blank\" rel=\"noopener\"><span style=\"background-color: #ffffff; font-size: 1rem;\">ASUFIN ha guanyat una demanda col\u00b7lectiva<\/span><\/a>\u00a0 que beneficiar\u00e0 a tots els que hagin pagat despeses per constituir la seva hipoteca, podent recuperar fins a 1.500 euros de mitjana <strong>sense necessitat de litigar, amb l&#8217;estalvi de costos i temps<\/strong> que aix\u00f2 suposa, de fins a quatre anys de mitjana.<\/p><p>L&#8217;acci\u00f3 col\u00b7lectiva de cessaci\u00f3 interposada per\u00a0ASUFIN\u00a0ha estat guanyada en el Jutjat del Mercantil n\u00fam. 11 de Madrid contra\u00a0<strong>Kutxabank, Banc de Caixa Espanya d&#8217;Inversions Salamanca i S\u00f2ria (ara Unicaja Banc), ING\u00a0Bank\u00a0i Deutsche Bank.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6bd5c31 elementor-align-center elementor-mobile-align-center elementor-widget elementor-widget-button\" data-id=\"6bd5c31\" data-element_type=\"widget\" <b>TOTALITAT<\/b> de les despeses satisfetes en concepte d'aranzel registral, despeses de gestoria i les despeses de taxaci\u00f3, mentre que respecte de l'aranzel notarial reclamarem el 50%.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"far fa-check-circle\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">En cas de tenir <b>comissi\u00f3 d'obertura<\/b>, tamb\u00e9 es pot Ent\u00e9n que guarda similituds amb el pagament indegut i, a m\u00e9s, disposa que l&#8217;inter\u00e8s legal exigible s&#8217;esdevingui des que es va signar el contracte, no des que es va iniciar la reclamaci\u00f3 judicial o extrajudicial. En equiparar-se una cl\u00e0usula abusiva a la mala fe, \u00abquan hagi de restituir-se una quantitat de <span style=\"text-decoration: underline;\"><strong>diners haur\u00e0 d&#8217;abonar-se
