Dit d&#8217;una altra manera, en una \u00e8poca en la qual el cr\u00e8dit estava restringit, una persona interessada en un habitatge podia accedir a finan\u00e7ament a trav\u00e9s de la pr\u00f2pia immobili\u00e0ria que li oferia la compra.<\/p><p>La principal peculiaritat d&#8217;aquestes hipoteques \u00e9s el\u00a0<strong>sistema d&#8217;amortitzaci\u00f3,<\/strong> que lluny d&#8217;inspirar-se en el sistema d&#8217;amortitzaci\u00f3 franc\u00e8s (el vigent en una hipoteca convencional), permet l&#8217;<strong>anatocisme<\/strong>, \u00e9s a dir, la <strong>capitalitzaci\u00f3 d&#8217;interessos.<\/strong> D&#8217;aquesta manera, milers de fam\u00edlies no hauran amortitzat per complet el seu pr\u00e9stec en finalitzar el per\u00edode pactat perqu\u00e8 <strong>el deute augmenta al mateix temps que augmenten els interessos deguts.<\/strong> A m\u00e9s, aquestes hipoteques estan referenciades a el <strong>\u00edndex de IRPH<\/strong> que tradicionalment s&#8217;ha situat per sobre de l&#8217;Euribor, la qual cosa suposava un previsible encariment de la hipoteca.<\/p><p>El passat 3 de mar\u00e7 de 2020, el\u00a0<strong>TJUE\u00a0<\/strong>es va pronunciar en la seva\u00a0sent\u00e8ncia assumpte C-125\/18\u00a0a favor dels consumidors, corregint aix\u00ed al Tribunal Suprem, que havia tancat la porta a reclamar aquelles hipoteques referenciades al\u00a0IRPH. Els jutges hauran de comprovar <strong>si es va explicar el\u00a0IRPH\u00a0de manera clara i transparent<\/strong> com perqu\u00e8 un consumidor mitj\u00e0 pogu\u00e9s comprendre el cost econ\u00f2mic que li anava a suposar.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3ba2fb5 elementor-align-center elementor-mobile-align-center No obstant aix\u00f2, UCI ha fet cas om\u00eds a aquesta jurisprud\u00e8ncia. A m\u00e9s, la sent\u00e8ncia del TJUE permet als tribunals espanyols dictaminar sobre la falta de transpar\u00e8ncia de la cl\u00e0usula IRPH.
