immobles\u00a0\u201csobre pla\u201d\u00a0i, per tant, pendent de la seva construcci\u00f3 a trav\u00e9s d&#8217;una <strong>promotora o cooperativa.<\/strong><\/p><p>At\u00e8s que ens trobem davant un escenari en el qual <strong>s&#8217;adquireix una cosa inexistent<\/strong>, resulten summament importants les garanties a futur que es formalitzen en el moment en el qual el consumidor presta el seu consentiment.<\/p><p>Aix\u00ed, el marc legislatiu actual ha brindat una especial protecci\u00f3 als compradors que, havent lliurat unes quantitats de diners a compte per a l&#8217;adquisici\u00f3 del seu habitatge, han vist que, passat un temps, <strong>no se&#8217;ls lliura l&#8217;immoble i tampoc se&#8217;ls retorna els seus diners.<\/strong><\/p><p>Aquestes promocions <strong>afecten a tota mena d&#8217;habitatges<\/strong>, habitatge habitual o vacacional, sempre que el comprador sigui un consumidor.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element Llei 57\/1968 tenen car\u00e0cter imperatiu i els drets que s&#8217;atorguen als adquirents dels habitatges s\u00f3n irrenunciables amb la finalitat de garantir-los la devoluci\u00f3 de les quantitats anticipades per a l&#8217;adquisici\u00f3 de l&#8217;habitatge.<\/p><p>Per aix\u00f2,\u00a0<span style=\"text-decoration: underline;\">no es poden vulnerar disposicions legals imperatives ni oblidar els drets que els consumidors,<\/span>\u00a0adquireixen pel fet d&#8217;incorporar-se a la Cooperativa i aportar a ella quantitats amb vista a l&#8217;adquisici\u00f3 d&#8217;un habitatge que ha de construir-se.<\/p><p>Malgrat que els bancs han argumentat que s\u00f3n aliens a la relaci\u00f3 entre comprador i venedor, el Tribunal Suprem ha negat rotundament tal circumst\u00e0ncia, deixant clar que<span style=\"text-decoration: underline;\">\u00a0l&#8217;entitat banc\u00e0ria t\u00e9 l&#8217;obligaci\u00f3 legal d&#8217;un especial deure de vigil\u00e0ncia sobre el promotor<\/span>\u00a0i les quantitats que rep a trav\u00e9s dels comptes bancaris que aquest tingui obert en el seu Banc.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element
