Los magistrados han estimado que si existi\u00f3 un error y vicio debido a la falta de informaci\u00f3n previa a la contrataci\u00f3n.<\/p>\n<p>El afectado suscribi\u00f3 el swap con barrera bajo la creencia de que se trataba de un seguro ante la fluctuaci\u00f3n de los tipos. La sentencia expone que no consta prueba alguna de la informaci\u00f3n previa a su firma. El Contrato Marco de Operaciones Financieras simplemente expone una informaci\u00f3n general que abarca una pluralidad y diversidad de contrataci\u00f3n; desde permutas financieras a operaciones de tipos de inter\u00e9s a plazo.
