El afectado, una pyme, firm\u00f3 el contrato bajo error y vicio en el consentimiento debido a una falta de informaci\u00f3n precontractual.<\/p>\n<p>Debido a esta falta, la entidad no cumpli\u00f3 con su obligaci\u00f3n de ofrecer la m\u00e1xima diligencia informativa a un cliente minorista, como exige la Ley del Mercado de Valores (LMV).<\/p>\n<p><span style=\"line-height: 1.5;\">B. Valencia deber\u00e1 pagar 37.300 euros al demandante por las p\u00e9rdidas generadas en forma de liquidaciones negativas.<\/span><\/p>\n<p>El Banco no realiz\u00f3 test de conveniencia, como exige la normativa MIFID. Tampoco expuso escenarios en los que actuara el producto.
