El Juzgado de Primera Instancia n\u00famero 5 de Oviedo ha estimado en otras tres ocasiones la nulidad por error y vicio en el consentimiento de deuda subordinada comercializada por Caja Espa\u00f1a (CEISS).<\/p>\n
La entidad incumpli\u00f3 la Ley del Mercado de Valores al ofrecer el producto a un cliente minorista sin garantizar el correcto entendimiento de los riesgos y funcionamiento de este.<\/p>\n
Dada su complejidad, CEISS debi\u00f3 realizar un test de conveniencia e idoneidad personalizado a sus clientes, pr\u00e1ctica que realiz\u00f3 como mero tr\u00e1mite, sin reflejar realmente los conocimientos financieros de sus clientes.<\/p>\n
Asimismo, present\u00f3 de una manera excesivamente simplificada (como un plazo fijo) el car\u00e1cter de las obligaciones, lo que no permiti\u00f3 a los afectados la suscripci\u00f3n con pleno conocimiento de causa.<\/p>\n
