{"id":45371,"date":"2019-09-09T12:51:05","date_gmt":"2019-09-09T10:51:05","guid":{"rendered":"https:\/\/www.asufin.com\/?p=45371"},"modified":"2020-04-25T20:45:40","modified_gmt":"2020-04-25T18:45:40","slug":"los-hipotecados-en-irph-han-pagado-165-euros-mas-al-mes-de-cuota-media-desde-2004","status":"publish","type":"post","link":"https:\/\/staging.asufin.com\/staging\/los-hipotecados-en-irph-han-pagado-165-euros-mas-al-mes-de-cuota-media-desde-2004\/","title":{"rendered":"IRPH: Los hipotecados en IRPH han pagado 165 euros m\u00e1s al mes de cuota media desde 2004"},"content":{"rendered":"\n<ul class=\"wp-block-list\"><li><strong>Ma\u00f1ana\nse conocer\u00e1n las conclusiones del abogado general del Tribunal de Justicia de\nla Uni\u00f3n Europea que empezar\u00e1n a marcar el destino judicial de los pr\u00e9stamos\nreferenciados a este pol\u00e9mico \u00edndice<\/strong><strong><\/strong><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Una\nestimaci\u00f3n basada en las hipotecas medias del mercado revela que la cuota media\npagada hasta este a\u00f1o con Euribor es de 917,8 euros, mientras que con IRPH asciende\na 1082,9 euros, lo que supone un total en el periodo de cerca de 25.000 euros<\/strong><\/li><\/ul>\n\n\n\n<p><strong>Lunes, 9 de\nseptiembre de 2019.<\/strong> Ma\u00f1ana, a las 9:30, se conocer\u00e1 la postura del\nabogado general del Tribunal de Justicia de la Uni\u00f3n Europea (TJUE), el polaco\nMaciej Szpunar, sobre la transparencia en la comercializaci\u00f3n de las hipotecas\nreferenciadas al IRPH. A la espera de ello, se encuentran cientos de\nhipotecados de alrededor de un mill\u00f3n de pr\u00e9stamos que, seg\u00fan la estimaci\u00f3n\nrealizada por ASUFIN, pagaron de media 165 euros m\u00e1s al mes desde 2004 hasta\neste a\u00f1o, con respecto a los que estaban referenciados al Euribor, lo que\nsupone un total de 24.987 euros de sobrepago, en t\u00e9rminos generales. Esto\nsignifica que el IRPH ha tenido un impacto econ\u00f3mico en el \u00e1mbito hipotecario\nde 25.000 millones de euros, que ahora la justicia europea tiene que dirimir.<\/p>\n\n\n\n<p>En concreto, lo que explica que el caso se encuentre\nen instancias de la Uni\u00f3n Europea es el cuestionamiento de la transparencia que\nhan efectuado magistrados en nuestro pa\u00eds. Una sentencia del Tribunal Supremo\n2017 a favor de Kutxabank que expon\u00eda que \u201cla mera referenciaci\u00f3n a un tipo\noficial como es&nbsp;el IRPH no implica falta de transparencia ni abusividad\u201d, pero\nno suscit\u00f3 unanimidad: el magistrado Francisco Javier Ordu\u00f1a Moreno vot\u00f3 en\ncontra&nbsp;y a \u00e9l se sum\u00f3 Francisco Javier Arroyo, porque consideraron que s\u00ed\ncab\u00eda alegar falta de control de la transparencia en la comercializaci\u00f3n de\nhipotecas indicadas al IRPH.
