{"id":47878,"date":"2020-01-30T11:18:43","date_gmt":"2020-01-30T10:18:43","guid":{"rendered":"https:\/\/www.asufin.com\/?p=47878"},"modified":"2021-06-08T10:06:19","modified_gmt":"2021-06-08T10:06:19","slug":"vista-per-sentencia-la-demanda-acumulada-dasufin-de-despeses-de-bbva","status":"publish","type":"post","link":"https:\/\/staging.asufin.com\/staging\/ca\/vista-per-sentencia-la-demanda-acumulada-dasufin-de-despeses-de-bbva\/","title":{"rendered":"Vista per sent\u00e8ncia la demanda acumulada d&#8217;ASUFIN de despeses de BBVA"},"content":{"rendered":"\r\n<h3 class=\"wp-block-heading\">Aquesta setmana ha tingut lloc l&#8217;audi\u00e8ncia pr\u00e8via d&#8217;aquest procediment que agrupa prop de 40 dels nostres associats<\/h3>\r\n\r\n\r\n\r\n<p>El passat mes de juliol de l&#8217;any 2017 ASUFIN presentar una de les nostres demandes acumulades contra BBVA per reclamar les despeses d&#8217;hipotec\u00e0ries i que amb el tr\u00e0mit d&#8217;audi\u00e8ncia pr\u00e8via que va tenir lloc dilluns, el procediment ha quedat vist per a sent\u00e8ncia.<\/p>\r\n\r\n\r\n\r\n<p>Malgrat que la demanda va ser admesa en un primer moment havent de presentar recurs d&#8217;apel\u00b7laci\u00f3, l&#8217;Audi\u00e8ncia Provincial 28 BIS de Madrid va dictar a l&#8217;octubre un acte pel qual estimava el nostre recurs i admetia a tr\u00e0mit la nostra demanda acumulada.<\/p>\r\n\r\n\r\n\r\n<p>En l&#8217;audi\u00e8ncia pr\u00e8via, el jutge va rebutjar l&#8217;excepci\u00f3 processal per indeguda acumulaci\u00f3 d&#8217;accions que va interposar BBVA ja que s&#8217;havia acordat que no hi ha obstacles processals per a l&#8217;acumulaci\u00f3 d&#8217;accions. A m\u00e9s, va admetre la prova documental.<\/p>\r\n\r\n\r\n\r\n<p>El procediment ha quedat vist per a sent\u00e8ncia, el que succeir\u00e0 en el transcurs d&#8217;un mes aproximadament, segons estimacions dels advocats col\u00b7laboradors de ASUFIN que porten el cas.<\/p>\r\n\r\n\r\n\r\n<p>El Tribunal Suprem, a la seva\u00a0<strong><a href=\"https:\/\/asufin.com\/sentencias\/supremo\/STS_151223_BPOPULAR_BBVA_OCU_SUELO_RESOLUCION_ANTICIPADA_INTERESES.pdf\" target=\"_blank\" rel=\"noopener\">Sent\u00e8ncia 705\/2015, de 23 de desembre\u00a0<\/a><\/strong>declarar nul\u00b7la, entre altres, la cl\u00e0usula per la qual el banc obliga el consumidor a pagar les despeses de formalitzaci\u00f3 de la hipoteca. Es calcula que m\u00e9s de 8 milions de consumidors haurien pogut pagar aquestes despeses indegudament i que ara podrien recuperar gr\u00e0cies a aquesta sent\u00e8ncia.
