Un matrimonio de jubilados recupera su dinero invertido en preferentes que canjearon por acciones posteriormente<\/h3>\n\n\n\n

El juez declar\u00f3 la “nulidad radical” por “inexistencia de consentimiento de la orden de valores de hasta 8.000 participaciones preferentes” de Banco Pastor y condena a la entidad hoy responsable, Banco Santander<\/a>, a devolver al matrimonio de jubilados hasta 800.000 euros de dicha inversi\u00f3n. <\/p>\n\n\n\n

ASUFIN aleg\u00f3 en el juicio falta de consentimiento, ya que el contrato de 2009 no fue firmado por los clientes. Adem\u00e1s, de falta de transparencia, al no haberles explicado los riegos reales de este producto. <\/p>\n\n\n\n

Esta sentencia es clave porque el juzgado admite que una asociaci\u00f3n sea la representante de los jubilados, algo que intent\u00f3 desmontar Banco Santander. ASUFIN demostr\u00f3 que cuando se vendieron estos productos, en 2009, su comercializaci\u00f3n estaba a la orden del d\u00eda. <\/p>\n\n\n\n
