Parlem d&#8217;una xifra aproximada de 8 milions d&#8217;hipoteques, segons el Banc d&#8217;Espanya.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b7da4b0 elementor-widget elementor-widget-text-editor\" data-id=\"b7da4b0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5><a href=\"https:\/\/twitter.com\/asufin_\" target=\"_blank\" rel=\"noopener\">Segueix-nos a les nostres xarxes socials per estar sempre informat<\/a><\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e3135da elementor-widget elementor-widget-text-editor\" data-id=\"e3135da\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Patricia Su\u00e1rez, presidenta d&#8217;ASUFIN, <strong>destaca el car\u00e0cter pioner<\/strong> de l&#8217;\u00e8xit d&#8217;aquesta sent\u00e8ncia: \u201c\u00c9s la primera vegada que es guanya en tribunals una acci\u00f3 de cessaci\u00f3 col\u00b7lectiva de despeses, despr\u00e9s de les recents sent\u00e8ncies del TJUE i el Suprem al juliol d&#8217;enguany\u201d. Afegeix que aquesta cl\u00e0usula abusiva \u00e9s una de les \u201cm\u00e9s transversals at\u00e8s que la van patir la pr\u00e0ctica totalitat dels hipotecats\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e10037d elementor-widget elementor-widget-text-editor\" data-id=\"e10037d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Sense necessitat de litigar<\/strong><br \/><br \/>Una de les conseq\u00fc\u00e8ncies m\u00e9s importants d&#8217;aquesta sent\u00e8ncia \u00e9s que <strong>qualsevol consumidor que tingui en la seva escriptura<\/strong> de constituci\u00f3 d&#8217;hipoteca <strong>una cl\u00e0usula de les quals apareixen en la part dispositiva de la sent\u00e8ncia<\/strong> pot demanar, <strong>en execuci\u00f3 de sent\u00e8ncia<\/strong>, aquesta devoluci\u00f3 com a beneficiari de la condemna (en virtut de l&#8217;article 519 de la Llei d&#8217;Enjudiciament Civil).<br \/><br \/>\u00c9s a dir, no fa falta iniciar una demanda individual, amb els costos que aix\u00f2 comporta, sin\u00f3 que directament <strong>pot veure&#8217;s beneficiat per l&#8217;\u00e8xit obtingut en aquesta demanda<\/strong>, de la qual la direcci\u00f3 lletrada ha estat a c\u00e0rrec de l&#8217;advocat col\u00b7laborador de ASUFIN, Agenor G\u00f3mez.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7c119d2 elementor-widget elementor-widget-text-editor\" data-id=\"7c119d2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5><a href=\"mailto:irph@asufin.com\">Tens IRPH? Escriu-nos a irph@asufin.com i t&#8217;ajudarem\u00a0<\/a><\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d3a2d41 elementor-widget elementor-widget-text-editor\" data-id=\"d3a2d41\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A m\u00e9s, la demanda col\u00b7lectiva guanyada en tribunal els hi evitar\u00e0 als afectats <strong>els temps d&#8217;un procediment ordinari<\/strong>, amb les seves diferents fases de la instrucci\u00f3, que nom\u00e9s en jutjats especialitzats com el 101bis de Madrid o el 50 de Barcelona ascendeixen a un any i mig, m\u00ednim, d&#8217;admissi\u00f3 a tr\u00e0mit i altres tres de tramitaci\u00f3.<br \/><br \/>L&#8217;acci\u00f3 col\u00b7lectiva de cessaci\u00f3 interposada per\u00a0ASUFIN\u00a0ha estat guanyada en el Jutjat del Mercantil n\u00fam. 11 de Madrid contra\u00a0Kutxabank, Banc de Caixa Espanya d&#8217;Inversions Salamanca i S\u00f2ria (ara Unicaja Banc), ING\u00a0Bank\u00a0i Deutsche Bank. En concret, els magistrats anul\u00b7len les cl\u00e0usules d&#8217;atribuci\u00f3 de despeses hipotec\u00e0ries i les entitats hauran de retornar el 100% de les despeses de registre de la propietat i el 50% de notari, gestoria i taxaci\u00f3 en la constituci\u00f3 d&#8217;hipoteca. A m\u00e9s els bancs hauran d&#8217;<strong>abonar els interessos<\/strong> legals des de la data de pagament de cada despesa.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6dbf082 elementor-widget elementor-widget-text-editor\" data-id=\"6dbf082\" data-element_type=\"widget\"
