I encara, centenars d&#8217;afectats per hipoteques multidivises continuen esperant una soluci\u00f3 per als seus pr\u00e9stecs en iens o francs su\u00efssos. Des d&#8217;ASUFIN denunciem davant la Comissi\u00f3 Nacional del Mercat de Valors (CNMV) i el Banc d&#8217;Espanya (BdE) que la desena d&#8217;entitats que tenen en cartera hipoteques multidivisa no estan informant els seus clients i que es podria obrir un nou front judicial per a aquestes 70.000 fam\u00edlies perqu\u00e8 <strong>la majoria de les escriptures contenen cl\u00e0usules de suport que podrien ser abusives.<\/strong><br \/><br \/>En una recent <a href=\"https:\/\/www.bde.es\/f\/webbde\/GAP\/Secciones\/SalaPrensa\/ComunicadosBCE\/NotasInformativasBCE\/21\/presbce2021_85.pdf\" target=\"_blank\" rel=\"noopener\">comunicaci\u00f3<\/a>, el Banc Central Europeu (BCE), l&#8217;Autoritat Europea de Valors i Mercats (ESMA), l&#8217;Autoritat Banc\u00e0ria Europea (EBA)\u00a0i la Comissi\u00f3 Europea van advertir a les entitats que hauran de deixar d&#8217;usar qualsevol dels 35 \u00edndexs de refer\u00e8ncia del\u00a0Libor\u00a0en qualsevol de les divises (d\u00f2lars, lliures, iens, francs su\u00efssos o euros) \u201ctan aviat com sigui possible\u201d i, en qualsevol cas, a partir del 31 de desembre de 2021 com a m\u00e9s tard. A partir d&#8217;aquest moment, hauran d&#8217;incloure cl\u00e0usules \u201crobustes\u201d de suport que determinin els substituts al\u00a0Libor.<br \/><br \/>I aquest context, certifiquem que les alternatives que la majoria d&#8217;afectats cont\u00e9 en els seus contractes no \u00e9s assimilable a una bona pr\u00e0ctica, en aquests moments.<br \/><br \/>Crida l&#8217;atenci\u00f3 el cas de\u00a0Kutxabank, que estableix com a substitutiu <strong>el controvertit\u00a0IRPH\u00a0Entitats<\/strong>, o els de Barclays (que hereta CaixaBank) i Caixa Seg\u00f2via (que hereta Bankia), que estableixen que es procedir\u00e0 a aplicar <strong>la cl\u00e0usula de venciment anticipat<\/strong> en cas de no arribar a un acord o per impossibilitat d&#8217;establir un \u00edndex alternatiu (en els casos de Bankia i BBVA). \u00c9s a dir, que es pot <strong>obligar el client a retornar la totalitat del pr\u00e9stec en el termini d&#8217;un mes.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-46c8ea6 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"46c8ea6\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-71153b7\" data-id=\"71153b7\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-544416c elementor-widget elementor-widget-text-editor\" data-id=\"544416c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5 style=\"text-align: center;\"><a href=\"https:\/\/panel.asufin.com\/archivos\/pdf\/210208_CUESTIONARIO_HIPOTECA_MULTIDIVISA.pdf\" target=\"_blank\" rel=\"noopener\">Si tenes una hipoteca multidivisa, reclama a trav\u00e9s del nostre qestionari<\/a><\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-7f49789 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7f49789\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-2b6b83f\" data-id=\"2b6b83f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1ffe269 elementor-widget elementor-widget-text-editor\" data-id=\"1ffe269\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En el cas d&#8217;entitats dins del Grup del Banc Popular no es preveu cap \u00edndex substitutiu, per la qual cosa segons informa la CNMV, s&#8217;aplicaria <strong>el designat per la Comissi\u00f3 Europea<\/strong>. El mateix resultat es d\u00f3na per als clients del Banc Sabadell que s\u00ed que remet a un \u00edndex que es determini per Llei o disposici\u00f3 normativa o administrativa.<br \/><br \/>En el cas de CaixaBank, estem davant un \u00edndex \u201cindefinit\u201d perqu\u00e8 assenyala que ser\u00e0 el de major analogia possible <strong>per\u00f2 no aclareix com se seleccionar\u00e0<\/strong>, mentre que altres entitats com Bankinter, Banc de Val\u00e8ncia, Bankia o Ibercaja, es refereixen a un \u00edndex alternatiu que el banc pugui obtenir en el mercat per a terminis dia a dia o similar.<br \/><br \/>Major concreci\u00f3 s&#8217;aprecia en les escriptures del Banc Santander i Deutsche Bank, que estableixen un \u00edndex alternatiu que <strong>vindr\u00e0 determinat per un o diversos bancs londinencs per\u00f2 que continua deixant al client a l&#8217;atzar del banc<\/strong>. Altres entitats han optat per establir un tipus fix que vindria establert per l&#8217;\u00faltim valor publicat, com \u00e9s el cas de Catalunya Caixa, Caixa Espanya i Caixa Seg\u00f2via.\u00a0 Finalment, Barclays proposa un per\u00edode per a negociar amb el client, mitjan\u00e7ant acord bilateral.<br \/><br \/>Des d&#8217;ASUFIN avisem que no sembla molt arriscat aventurar que si les entitats financeres i els seus clients no arribessin a un acord, es podria obrir un nou front en la litigiosidad banc\u00e0ria en considerar que <strong>aquestes cl\u00e0usules no s\u00f3n transparents, podent ser declarades abusives.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>La majoria d&#8217;escriptures dels afectats contenen cl\u00e0usules que podrien ser abusives, com l&#8217;IRPH de Kutxabank o un venciment anticipat que obligaria a retornar tot el pr\u00e9stec en un mes El 31 de desembre el Libor passar\u00e0 a ser hist\u00f2ria.
