Sol\u00b7licit\u00e0vem, que es condemn\u00e9s a l&#8217;entitat <strong>a retornar al demandant el 50% dels aranzels notarials i la totalitat de les despeses registrals i de gestoria. <\/strong><\/p>\n<p>Per part seva, ING Bank <strong>s&#8217;aplana en la sol\u00b7licitud de declaraci\u00f3 de nul\u00b7litat de la cl\u00e0usula de despeses d&#8217;hipoteca<\/strong> per abusivitat continguda en la hipoteca subscrita entre les parts l&#8217;any 2014.<\/p>\n<p>I \u00e9s per aquest aplanament, que el Jutjat de Primera Inst\u00e0ncia n\u00famero 5 d&#8217;Alacant <strong>estima \u00edntegrament la nostra demanda de manera immediata i dicta una sent\u00e8ncia condemnat\u00f2ria<\/strong>, per la qual es condemna a ING Bank a retornar 1.221\u20ac als nostres socis.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-afa4ba9 elementor-widget elementor-widget-text-editor\" data-id=\"afa4ba9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5><a href=\"https:\/\/staging.asufin.com\/staging\/irph-volvemos-a-europa\/?utm_source=Sendgrid&amp;utm_medium=email&amp;utm_campaign=website\" target=\"_blank\" rel=\"noopener\">El IRPH torna a Europa, el pr\u00f2xim 26 d&#8217;abril analitzarem les \u00faltimes novetats. No t&#8217;ho perdis!<\/a><\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e59e21 elementor-widget elementor-widget-text-editor\" data-id=\"4e59e21\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Segons la llei un aplanament es produeix quan el demandat accepta les<strong> al\u00b7legacions que fa el demandant en la demanda i est\u00e0 d&#8217;acord amb la sol\u00b7licitud de la part<\/strong>. I com a conseq\u00fc\u00e8ncies de l&#8217;aplanament i la declaraci\u00f3 de nul\u00b7litat de la cl\u00e0usula de despeses d&#8217;hipoteca, seguint els criteris establerts pel <a href=\"https:\/\/curia.europa.eu\/jcms\/jcms\/j_6\/es\/\" target=\"_blank\" rel=\"noopener\">TJUE<\/a>, es condemna a ING Bank a retornar el 50% dels aranzels notarials, ja que totes dues parts s\u00f3n considerades interessades a obtenir aquest document.<\/p>\n<p>D&#8217;altra banda,<strong> els costos del registre de la propietat han de ser pagats \u00edntegrament per l&#8217;entitat<\/strong> ja que existeix una llei de dret nacional que aix\u00ed ho estableix.
